Right of withdrawal

For a purchase made at a distance (reservation by phone, e-mail or WhatsApp), a consumer customer has 14 days from receipt of the item to withdraw from the contract, without giving any reason.

No particular form is required: simply inform Le Chineur du Passé Simple of your decision with a clear statement, for example by e-mail to contact@lechineurdupassesimple.fr, by post to the registered address, or by using the withdrawal form below.

The item must be sent back or brought back no later than 14 days after this notice, in the condition in which it was received. Return costs are paid by the customer. All sums paid, including the initial delivery costs, are refunded within 14 days of receiving the withdrawal decision. The refund may be withheld until the item has been recovered or until the customer has supplied proof of having sent it back.

The right of withdrawal does not apply to sales made in the shop.

Delivery and shipping

Furniture and bulky items: delivery within 30 days at most in France, and 40 days for the rest of Europe. The customer is told the delivery date in advance.

Items under 20 kg: shipped within 10 working days of the order. Carriers: La Poste, Mondial Relay, Chronopost, UPS, DHL, etc. A tracking number is sent as soon as the item is shipped.

Transport, breakage and delivery disputes

Items are packed with the greatest care. When transport is arranged by Le Chineur du Passé Simple, the risk of loss or damage remains with Le Chineur du Passé Simple until the item is handed over to the customer.

On delivery, the customer is asked to check the condition of the parcel and the item in the presence of the carrier, to write precise reservations on the delivery note if anything is wrong, and then to inform Le Chineur du Passé Simple as soon as possible, with photos if possible. Le Chineur du Passé Simple handles the claim with the carrier and offers the customer a repair of the item where possible, or a refund.

If the customer uses a carrier of their own choice, not offered by Le Chineur du Passé Simple, the risk passes to the customer as soon as the item is handed over to that carrier.

Shipping costs

Delivery costs are given before the order. They depend on weight, destination and the carrier chosen.

For delivery outside France, a request can be made by e-mail or phone. Le Chineur du Passé Simple may decline certain destinations. Any customs duties are paid by the buyer.

Data protection

The data collected (surname, first name, address, phone number, e-mail) are used only to manage orders and may be passed on to the carrier. They are never sold or used for advertising.

Disputes and mediation

In case of difficulty, the customer is invited to contact Le Chineur du Passé Simple first, to look for an amicable solution together.

If a consumer customer has sent a written complaint to Le Chineur du Passé Simple and it remains unresolved, they may use, free of charge, the consumer mediator to which Le Chineur du Passé Simple belongs, under articles L. 612-1 et seq. of the French Consumer Code: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net. The mediator must be contacted within one year of the written complaint.

Failing agreement, the dispute is brought before the competent court under the ordinary rules of law. A consumer customer may in particular choose the court of the place where they lived when the contract was concluded or when the harmful event occurred.
